LCC officials set free

LUSAKA City Council officials have been excluded from a case where the Zambia Environmental Management Agency (ZEMA) sued the local authority for negligent garbage disposal and management.

LCC public relations manager George Sichimba in a statement said the Lusaka Town Clerk Alex Mwansa and Acting Director of Public Health Edgar Mulwanda were set free when the case come up for preliminary issues ruling before resident magistrate Felix Kaoma.

In his ruling magistrate Kaoma said the indictment against the duo was defective in that it did not include them in the initial complaint documents that were lodged before the courts.

Magistrate Kaoma observed that the complaint lodged before the court did not contain the names or the charges against the duo.

The duo was represented by Jeah Madaika of J&M Associates and LCC Director of Legal Services Bibiana Bulaya.

On 24th August this year, ZEMA sued LCC for failure to comply fully with Site Restoration Orders issued on 1st August, 2018. This is in relation to the LCC failure to dispose of garbage in Kanyama compound.

Mwansa and Mulwanda were charged in their official capacities as Town Clerk and Director of Public Health respectively.
