Fire fighter goes in 6 months for assault

A fire fighter from Mansa Municipal Council fire Brigade Unit has been sentenced to six months imprisonment with hard labour for assault.

Appearing before Mansa Senior Resident Magistrate Dominic Makalicha was Collins Phiri 36 of Dasto Village in Chief Kalasa Lukangaba’s Chiefdom in Mansa District.

Phiri was found guilty of assault occasioning bodily harm contrary to Section 248 Cap 87 of the Laws of Zambia.

Particulars of the offence are that on October 11, 2018 Phiri being a fire fighter at the Mansa Municipal Council did assault Pilate Chileka a security guard.

Facts before the court where that on October 11, 2018, Phiri went for work and found the gate at the Fire Brigade closed and ordered Chileka to open and in the process begun beating Chileka leaving him injured.

In mitigation, Phiri through his Legal Aid lawyer Oscar Mudenda, pleaded with the court to be lenient with him as he was the first offender and was remorseful of his actions.

In passing Judgement, Magistrate Makalicha said he put into consideration Phiri’s mitigation but said the offence committed was punishable by law.

He wondered how one could take the law into his hands and found Phiri’s actions uncalled for which cannot be condoned.

Magistrate Makalicha said as a deterrent to would be offenders especially in work places, he sentenced Phiri to six months imprisonment with hard labour with effect from January 28 and that he had 14 days within which to appeal if he was not happy with the sentence.
