Chipata Magistrate Put Juvenile on One Year Probation

The Chipata Magistrates’ Court has ordered that a juvenile offender, who is facing one count of defilement, be put on probation for one year under the Social Welfare Department in Chipata district.

This was after Christabel Sampa, a probation officer from the Social Welfare Department asked the court to consider putting the juvenile offender on probation and undergo counselling.

Sampa who presented a social welfare report in mitigation on behalf of the juvenile offender, before Principal Resident Magistrate Jennipher Bwalya, asked the court to exercise leniency as he is a first offender who readily pleaded guilty to the offence.

She said it is sad that the offence the juvenile offender committed is serious and that defilement has become rampant in communities.

Sampa said the juvenile offender is remorseful and that he regrets his actions.

Facts before the court are that the juvenile offender on unknown dates but between January 1 and 5,  2018, had unlawful carnal knowledge of a girl under the age of 16.

When Magistrate Bwalya asked the juvenile offender if he had anything to say in mitigation, he asked the court to exercise leniency, as he usually assists his mother financially.

When passing ruling, magistrate Bwalya said she had taken into consideration the mitigation presented before the court by the probation officer and that of the juvenile offender.

She therefore, ordered that the offender be put on observation for one year under the social welfare department.

The magistrate further ordered that both the juvenile offender and the victim undergo counselling.
