Choma court fines man for assaulting DEC officer

The Choma magistrates’ court has fined a 34-year-old man for assaulting a Drug Enforcement Commission (DEC) officer.

Particulars of the offence were that on August 1, 2015, DEC officers received information that one someone was selling cannabis to members of the public in Chandamali compound.

Officers acted on the information and identified the suspect as Justine Kayawe who was later spotted at Chandamali Community School.

A scuffle ensued as the officers tried to apprehend him and in the process Kayawe bit an officer’s finger as he was being dragged into the vehicle.

But in defense, Kayawe argued that it was in fact the officers that beat him up severely to a point where one of his teeth came out and two were left loose.

Kayawe claimed that the officers charged him for assault occasioning actual bodily harm after they saw how badly they had beaten him as a way of countering the charge.

In passing judgment, magistrate Maimbolwa Mukela said Kayawe was a first offender that deserved lenience considering the circumstances of the offence.

She then fined Kayawe K600 to be paid before January 31, 2018 or face nine months simple imprisonment.
