Mwense man, 28 goes in 3 years for burglary

Mwense Magistrate’s court has sentenced a 28 -year-old small scale farmer of Kashiba chiefdom in Luapula Province to three years imprisonment for burglary.
Before Magistrate Fred Mwangala sitting as class III was Renard Kapungwe of Mukopa village who stood charged for burglary contrary to section 301 subsection (a) of the penal code chapter 87 of the laws of Zambia.
In count one, particulars of the offence were that on February 7, 2019, Kapungwe wilfully with intent to steal, broke and entered into Lizzy Kaputo’s house and indecently assaulted the latter.
And in count two, Kapungwe was charged for indecent assault on females contrary to section 137 subsection (1) of the penal code chapter 87 of the laws of Zambia as amended by Act number 15 of 2005.
The convict however, pleaded not guilty in both counts but when the matter went into trial, he was found guilty for burglary while for indecent assault, he was acquitted.
In mitigation, the convict requested the court for lenience as he was a first offender who was looking after his sick mother, two children and a cassava field.
And when passing judgment, magistrate Mwangala said though the convict was a first offender, the court has a duty to protect the hard-earned property of people in the community.
He then sentenced him to three years imprisonment with hard labour effective the date of arrest as a deterrent measure.
