Lusaka court discontinues lawyer Nchima personation case following withdrawal By Staff Reporter
THE Lusaka Magistrates’ Court has discontinued a matter in which former Post employee Abel Mboozi accused lawyer Nchima Nchito of personating a legal representative for the media company undergoing a state-orchestrated provisional liquidation process.
In the matter before magistrate Humphrey Chitalu, it was alleged that Nchima between November 1, 2016 and February 2017 in Lusaka and with intent to defraud filed a matter in the High Court thereby falsely representing himself as an advocate genuinely appointed by the Post Newspapers Limited (In Liquidation).
Nchima was being represented by Musa Mwenye in this matter while Mboozi, who recently caused the acquittal of Post Newspapers editor Fred M’membe in a matter of concealment of the newspaper company’s assets in view of the provisional liquidation, was being represented by private lawyer, Rabson Malipenga.
When the year-long matter came up for hearing of an application by Mboozi to have the case withdrawn, Mwenye noted that the complainant, who had already instructed his lawyer to apply to have the matter withdrawn, had not been appearing before the court.
On November 8, magistrate Chitalu had ordered that Mboozi should be present in court on November 20 for the hearing of his application to have the case withdrawn.
“I have full instructions to withdraw this matter,” Malipenga said then, adding that he had informed the defence about the turn of events.
However, Mwenye said the matter could only be withdrawn in the presence of the complainant, a position that magistrate Chitalu agreed with.
