Losing Sesheke parliamentary by election candidate appeals

LOSING PF candidate in the Sesheke parliamentary bye election Dean Masule has appealed to the Constitutional Court against the High court’s decision to declare UPND’s Romeo Kangombe as duly elected member of parliament for Sesheke constituency.
Lusaka High Court judge Gertrude Chawatama on May 28 this year dismissed allegations of electoral malpractices against Kanhombe and declared him validly elected.
Judge Chawatama said Masule, who was the petitioner, failed to prove that Kangombe personally participated in the electoral malpractices and that the acts prevented the people of the constituency to vote for a candidate of their choice.
But Masule has lodged an appeal, stating that he is dissatisfied with judge Chawatama judgment.
He has argued that judge Chawatama erred in law when she held that the provisions of section 97 (2)( b ) of the Electoral Process Act no 35 of 2016 exclusively governed the activities of the Electoral Commission of Zambia, among other issues.
