A Lusaka man, James Chongo has sued a money lender for flouting the contractual obligations they had entered into relating to the use of a light Canter truck used as surety in a 30,000 Kwacha loan transaction.<\/p>\n
Chongo is seeking compensation and other relief from Iness Daka, a money lender of Lusaka for using his light truck canter registration number ALZ 6471, which he had used as surety when he borrowed K30,000 from her in November 2016.<\/p>\n
In his claim during a matter before magistrate Greenwell Malumani, Chongo alleges that Daka ignored or neglected to adhere to the agreed contract not to use the vehicle in any way until the debt was settled in full.<\/p>\n
Facts before the court were that in November 2016, Chongo borrowed K30, 000 cash\u00a0 from Daka for his transport business and a light Canter truck, registration number ALZ 6471 was surrendered as\u00a0 a guarantee .<\/p>\n
However, on December 15, Chongo found his truck laden with goods around Independence Stadium area in Lusaka, heading towards Central province, a situation which shocked him and he called Daka.<\/p>\n
By the time of court sitting, the light truck was still in Daka\u2019s \u00a0possession in Kabwe.<\/p>\n
It was heard that in the first five weeks the truck is believed to have been operating in Lusaka, whilst the driver confirmed cashing K1,300 over the weekends. As of November 2017, it is alleged that a total of K63, 400.00 was cashed in.<\/p>\n
During hearing, Magistrate Malumani cautioned people against presenting civil matters such as the one in question to the police as it was an inappropriate jurisdiction.<\/p>\n
The matter comes up on Monday, November 27 for ruling.<\/p>\n
